The Court noted that the types of mistreatment the petitioner suffered at the hands of her husband constituted gender-based violence as defined by the Declaration of the Elimination of Violence Against Women. Indeed, the abuse was based on the unequal power relations between the husband and wife and caused the petitioner serious psychological suffering.
“The respondent subjected the petitioner to treatment that denied her right to equality in the marriage relationship. The respondent took advantage of the unequal power relation between him and the petitioner and subjected her literally to conditions that did not enable her attain the highest standard of physical and mental health…The petitioner shall be responsible for food, housing medical contribution, and any other incidental expenses for the said child.”(Quoted form Original Judgment)
